Very overgrown trees growning over fence onto private property A508

Sent to West Northamptonshire Council less than a minute later. ref: 6372360.

The trees on the verge of the A508 are very overgrown and intruding onto private property on 39 Stonehill Way. The branches are so big they overhang the drystone wall and not far from the house now. They are growing over the greenhouse and shed in the garden. They are up high on a bank and there is a slope down which could be a problem in high winds. They are now dangerous and need to be cut back urgently

  • Investigation: Ongoing (Reported to a third party) - Thank you for your enquiry. A qualified Highways Inspector has assessed the location and we can confirm that the vegetation is the responsibility of the landowner. In accordance with the WNC Network Management Plan, we will contact the landowner and request they cut back their vegetation within 14 days of receipt of our correspondence. We will reinspect the vegetation to ensure they have complied.

  • I need to know why my local officer has refused to help me when reporting similar risk of harm and damage. He said not the responsibility of the local authority and refused to help. Please can a person explain how this is possible ?

  • Investigation: Ongoing (Reported to a third party) - Unfortunately without wider context, this question may be hard to answer. If the trees are growing onto your property, Highways cannot carry out work on private land, or on private trees/vegetation. It would be either a neighbourly dispute, or there is a common law right which permits a person (or their agent i.e. tree surgeon, gardener, etc) to prune back any growth of tree, shrub etc to the line of their boundary, as long as any cuttings are disposed of in a responsible manner, i.e. not dumped on public property or private land.

    Depending on the vegetation in which you are referring to, will depend on the possible reasoning it may not be a highways matter to resolve. To help you further, you could raise a new report in the location that you are referring to, and we can look into this further for you. We hope this has assisted.
