Under the Highways Act 1980, it is generally illegal for a private individual to place cones or other obstructions on a public road or footpath without permission from the local highway authority. Key points: Section 137 of the Act makes it an offence to wilfully obstruct the free passage along a highway, which includes placing cones to reserve parking or block access.

Only authorised bodies such as the police, local authority, or utility companies may place cones or barriers on the road for safety, traffic management, or repair work. Cones placed without permission can be removed by the local council, and the individual responsible can be fined or prosecuted.
